Version 2026-11-02.1
Course terms
Clarity-OO Ltd — Clarity CDM Academy course terms — version 2026-11-02.1
These terms are the agreement between Clarity-OO Ltd ("Clarity", "we", "us") and the person or business that buys a course from Clarity CDM Academy ("you"). Please read them before you buy. They are in four parts:
- Part A applies to everyone.
- Part B applies only if you buy as a consumer: an individual buying for purposes that are wholly or mainly outside your trade, business, craft or profession.
- Part C applies only if you buy as a business: a company, partnership, sole trader or other organisation, or an individual buying for your trade, business, craft or profession.
- Part D applies to everyone.
Our privacy notice, refunds and cancellation page and cookies page form part of these terms. Where they differ from these terms, these terms apply.
Clarity-OO Ltd is registered in England and Wales, company number 17484245. Registered office: 2b Henry Street, Blackburn, BB1 4JJ, United Kingdom. VAT number GB530797965. Contact: support@clarity-oo.com.
Part A - Everyone
1. Words used in these terms
- Academy: Clarity CDM Academy at academy.cdm2015.co.uk.
- Course: one online course listed in the Academy's catalogue, for example "CDM 2015 for Principal Contractors - Introductory Course" or "CDM 2015 for Principal Contractors - Full Course". Each Course is sold separately and stands alone.
- Learner: the one named person who takes the Course, sits its assessment and is named on its certificate. If you buy for yourself, you are the Learner. If a business buys, the Learner is the person named at checkout.
- Assessment: the end-of-module checks and the final exam of a Course, including any practical piece.
- Certificate: the Certificate of Achievement we issue to a Learner who passes a Course's final exam.
- Access period: the time during which the Learner can open the Course: from the day of purchase until the Learner passes the final exam, and then for 3 years from the day of the pass (the Certificate's valid-until date, section 5). If the Learner never passes, access stays open.
- Order: one purchase of one Course for one Learner, with its order reference.
2. Who may buy
- The Learner must be 18 or over, and so must the buyer. By buying you confirm that you are 18 or over and, if you are buying for someone else, that the Learner is too. We do not sell to anyone under 18, and we may cancel an Order, without refund of any course already started, if we learn that the Learner was under 18 when it was placed.
- We sell to buyers with a billing address in the United Kingdom, paying by debit or credit card through Stripe. We do not currently sell to buyers elsewhere. If an Order is placed from outside the United Kingdom we cancel it and refund it in full.
- You must give a working email address. It is how we send your receipt, your sign-in link and everything else about your Course.
- If you buy as a business, Part C also applies and you confirm you have authority to agree these terms for that business. You tell us you are a business by ticking the box at checkout that says "I am buying as a business (a company, partnership, sole trader or other organisation, or for my own trade or profession). Employees buying for their own job should not tick this." We never treat you as a business because of a company name or VAT number alone. If you tick this wrongly, the law still treats you as a consumer and Part B applies.
- Each Order is for one Learner. To train several people, buy one place for each person.
3. The contract: how and when it is made
- You choose a Course, give your details on our pre-checkout page and confirm that you agree to these terms, then pay by card on Stripe's secure checkout page. Stripe takes the payment; Clarity-OO Ltd is the seller.
- The contract between us is made when Stripe confirms to us that your payment has succeeded. Until then there is no contract, and nothing you have entered commits either of us. If the payment fails or you leave the checkout page, no Course is bought.
- When the contract is made we email you a confirmation and VAT invoice (section 6). It names the Course, the Learner, the price and the version of these terms that applies. For consumers, the email itself sets out your right to cancel: the 14 days, how to cancel, and how the right is lost at "Start the course now" (section 16), and it points to the model cancellation form. A copy of the version of these terms you agreed to, with the model cancellation form, is attached to that email as a PDF. Keep both: they are your record of the contract. (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 16.)
- If the Learner is new to the Academy, the same email carries a one-time link to set a password. The link works once and for 7 days; after that, use "Forgotten password" on the sign-in page. A Learner who already has an account sees the new Course on their dashboard when they next sign in.
- We may refuse an Order where we have good reason, for example a payment that Stripe flags as fraudulent, an email address that does not work, or an earlier breach of section 7. If we refuse after payment, we refund in full.
4. What you need to take a Course
- You need:
- a web browser released in the last two years (current Chrome, Edge, Firefox or Safari) on a computer, tablet or phone, with JavaScript and cookies enabled and an internet connection. No software is installed;
- a screen at least 360 pixels wide. A phone works; a laptop or tablet is easier for the drawing-based questions;
- a mouse, trackpad or touch screen for drag-and-drop and hotspot questions. A keyboard or list alternative is provided for every such question (section 4A);
- speakers or headphones for the narrated audio. Every narration has a written transcript;
- a PDF reader for your course pack, invoice and Certificate.
- The Course is streamed and cannot be used offline. Lesson text, templates and your completed course pack can be downloaded as PDF files once they are available to you. You cannot download the lessons as video or audio files.
- There is no copy protection on the PDFs; section 10 says what you may do with them.
- The exam uses a server-side timer: if your connection drops, your saved answers survive, but the clock keeps running (section 5).
- The information in this section, and the description of each Course on its course page, forms part of the contract (Consumer Rights Act 2015, sections 37 and 50).
4A. Accessibility and adjustments
- We want every Learner to be able to take a Course. Narrated audio has a written transcript; images used in questions have text descriptions; every drag-and-drop or hotspot question has a keyboard or list alternative.
- If you need an adjustment - for example extra exam time, a different question format or a reset attempt - email support@clarity-oo.com before you start the exam and we will agree one with you. We never charge for an adjustment. Our privacy notice says how we handle what you tell us about your needs.
- If something on the Academy is hard to use with the way you work, tell us at support@clarity-oo.com and we will put it right or agree an alternative with you.
5. What you get
5.1 The Course
- The Course described on its course page: its modules in order, each ending in a short check that must be passed (80%) before the next module opens; a final exam at the end; and, for Full Courses, a practical piece marked with the exam. Module checks can be retried as many times as you like, with an instant result.
- You take the Course at your own pace. Your place is saved and you can return later.
- Module 1 is shared between our Courses. A Learner who has passed Module 1 in one Course has it credited in the next.
- A course pack (PDF) when you have passed: a personalised cover, a summary of what you learnt, the templates and checklists, the worked project's documents, your marked answers with feedback, and the lesson text as an appendix. The Certificate is a separate PDF.
5.2 The exam and retakes
- The exam is sat in one sitting with a time limit shown before you start (about 30 minutes for an Introductory Course, 90 minutes for a Full Course). When the time runs out, your saved answers are submitted automatically.
- The pass mark is 70% for an Introductory Course and 80% for a Full Course, as shown on the course page.
- Retakes are free and unlimited during the Access period. If you fail, you may sit the exam again straight away. For a Full Course we do not show you the answers you got wrong; we point you to the module or regulation to revisit. For an Introductory Course we show the right answer with an explanation.
- A pass on a retake issues a new Certificate, which replaces the earlier one and starts a new 3-year period.
5.3 The Certificate and the Access period
- When the Learner passes the final exam, we issue the Certificate of Achievement named on the course page (for example "CDM 2015 for Principal Contractors - Certificate of Achievement") in the Learner's name, dated the day of the pass and valid for 3 years from that day. The valid-until date is printed on it. Anyone can check a Certificate on our public page academy.cdm2015.co.uk/verify by entering its code.
- Access to the Course lasts until the Certificate's valid-until date: re-read any module, retake the exam, and download your pack and Certificate. Before you pass, access is open while you study.
- When the Access period ends, access ends. The Course closes on your dashboard. Downloads stay open for a further 30 days so you can fetch your pack and Certificate. We email you 30 days before the valid-until date to remind you.
- Retaking after the Access period has ended means buying the Course again, at the price then shown, on the same sign-in. The retake runs the whole Course again from the start (Module 1 stays credited; your notes stay). Inside the Access period, retaking the whole course is free. Section 9 explains what the Certificate does and does not mean.
6. Prices, VAT and invoices
- The price is the one shown on the course page when you buy. Each Course is a one-off payment for one Learner. There is no subscription, no renewal and no automatic charge later.
- Clarity-OO Ltd is VAT-registered, VAT number GB530797965. Prices are shown including UK VAT at the current rate, as the total you pay, with the price before VAT alongside for business buyers. The checkout page shows the total before you pay. The total shown is the amount Stripe will charge; there are no extra fees.
- Every Order gets a VAT invoice, emailed with your confirmation. It shows the Course, the price before VAT, the VAT and the total, our VAT number, and - if you bought as a business - your business's name, VAT number and billing address as the customer, so that the business can reclaim the VAT. The buyer's copy is the one emailed; the Learner can download the invoice again from their account at any time.
- We never see or store your card details. Stripe holds them.
- We may change prices for the future. A change never affects a Course you have already bought.
7. Your account and acceptable use
- One Learner, one account, one person. The account, the Course, the exam and the Certificate belong to the named Learner alone. Nobody else may sign in as the Learner, sit any part of the Assessment for them, or help them in the exam. We may ask for proof of identity if we suspect this has happened.
- Keep your password safe and tell us straight away at support@clarity-oo.com if you think someone else has got into your account. If you have kept your password safe, you are not responsible for use of your account that you could not reasonably have known about. If you knowingly let someone else use it, or ignored signs it had been taken over, this section and section 9 apply.
- Keep your name correct: it goes on the Certificate. You can change it in your account until a Certificate is issued. After that, email us and we will correct a genuine error and re-issue.
- You must not:
- share your account, or let anyone else take a Course or exam in your name;
- copy, download in bulk, scrape, record or redistribute course content, exam questions, answers or marking materials, or use bots, scripts or automated tools on the Academy;
- try to get into accounts, data or systems that are not yours, or test, probe or overload our systems;
- use our content to build or run a competing course or product;
- break the law with the Academy, or use it to store or send anything unlawful or harmful.
- If you break this section, section 14 applies and we may revoke a Certificate (section 9).
8. Marking, feedback and your right to a human review
- Multiple-choice, numeric, sequence, hotspot and similar questions are marked by our software against fixed answers.
- Written answers, "true or false with a reason" answers and the practical piece are marked automatically by an artificial-intelligence service against a marking rubric we wrote. The marking is fully automated so that your result is not held up; it is fast but not perfect. Our privacy notice says what is sent to the AI service and what is not.
- Pass or fail is decided by your total mark. It is an automated decision. You have the right to ask a person to review it. Email support@clarity-oo.com with your attempt reference and what you think was marked wrongly. We ask you to do this within 30 days of your result so the attempt is fresh; a later request is still considered, but the review may be limited to what we still hold. A tutor will read your answers against the rubric, may change the mark, and will tell you the outcome within 14 days. If the review takes you over the pass mark, we issue your Certificate dated the day of the review. (UK GDPR Article 22; Data Protection Act 2018.)
- You may also simply retake the exam, free, as often as you like during the Access period (section 5.2).
- We may change the questions in any exam at any time, so a retake is not the same paper.
9. The Certificate: what it means and what it does not
- A Certificate of Achievement records that the Learner passed our assessment of that Course on the date shown. It is issued by Clarity CDM Academy (Clarity-OO Ltd) and signed by our director, Paul Scanlon.
- It is our own certificate. It is not a qualification on a national framework, it is not accredited or approved by any awarding body, professional institution or regulator, and it is not a licence, card or permit to carry out any work or hold any appointment.
- It is not proof of competence. Under the Construction (Design and Management) Regulations 2015 (regulation 8), anyone who appoints a dutyholder must satisfy themselves about that person's or organisation's skills, knowledge, experience and organisational capability. Passing a knowledge course is one piece of evidence toward that, never the whole of it. The Certificate says nothing about experience or about an organisation's capability, and neither we nor the Learner may represent it as doing so. Nothing on our course pages or in our marketing changes this section.
- CPD. The Certificate states the Course's hours of learning. The Learner may record them as CPD if their professional body or employer accepts self-recorded learning. Our Courses are not accredited by any CPD body, and we do not use the words "accredited", "approved" or "certified CPD", or any body's logo, about them. It is for the Learner to check what their own body accepts.
- Validity. A Certificate is valid for 3 years from its date and then expires. Our public verify page shows Current, Expired, Revoked or Withdrawn (where the Learner has asked us to erase their data).
- Revocation. We may revoke a Certificate, and will show it as Revoked on the verify page, if:
- someone other than the Learner sat any part of the Assessment, or the Learner had help in the exam;
- the Learner used a false name or was under 18 when the Order was placed;
- the content, questions or answers were copied or shared in breach of section 7; or
- the whole price of the Order is reversed by a chargeback, or refunded in full at your request, after the Certificate was issued. A partial refund or price reduction under section 18 or 22 never leads to revocation. We will tell the Learner why. A Learner may ask us to look again by emailing support@clarity-oo.com.
10. Our content and your use of it
- We own, or are licensed to use, the Courses and their content: text, images, audio, drawings, questions, templates and software. Buying a Course does not transfer any of it to you, and nothing in a Course may be copied beyond what this section allows.
- Our Courses quote the Construction (Design and Management) Regulations 2015 and HSE guidance, which are Crown copyright and reproduced under the Open Government Licence v3.0. Our rights do not extend to that text.
- What you may do. During the Access period the Learner may read, listen to and work through the Course for their own learning, and keep the course pack and Certificate PDFs for their own use after it. The templates and checklists in your pack may be used by you, or by the business you work for, in your or its own work, adapted as you see fit. You may not sell them, publish them, or pass them off as your own training material.
- Our Courses describe the law and HSE guidance as we understand them on the date stated on each course page. Where a Course refers to enforcement action against named organisations, it reports what HSE or the courts made public, as a teaching example, and says nothing about that organisation's practice today.
- If you send us suggestions or report an error, we may use what you tell us freely, and we thank you for it.
11. Keeping the Course current
- The Courses teach the Construction (Design and Management) Regulations 2015 and the guidance around them. Law and guidance change. We may update a module, check, exam or template to reflect changes in law or HSE guidance, to correct errors, or to improve how it teaches, including while you are part way through. After any update the Course will still match its description on the course page and these terms, cover the same learning outcomes, and carry the same pass marks and time limits. If you are part way through an exam, an update never changes the paper you are sitting. Each course page states when its content was last checked against HSE guidance.
- An update does not shorten your Access period, affect a Certificate you already hold, or entitle you to a refund, unless the update means the Course no longer matches its description, in which case section 18 applies. Where a change is significant we tell Learners with open access by email.
- If we withdraw a Course entirely during your Access period, you keep access to its last version until your Access period ends or, if we cannot keep it available, we send you its full lesson text, templates and your pack as PDF files. A consumer who has not yet started the Course is refunded in full.
12. Availability and faults
- We provide the Academy and its Courses with reasonable skill and care, and as described on the course pages.
- We work to keep the Academy available and secure and to fix faults promptly. We do not promise it will be uninterrupted or error-free. We may take it offline briefly for maintenance, preferably outside UK working hours.
- If a fault on our side interrupts an exam sitting, tell us at support@clarity-oo.com. We will reset the attempt so you can sit again without penalty. A dropped connection on your side does not stop the exam clock, but your saved answers are kept.
- If something is wrong, tell us at support@clarity-oo.com and give us a reasonable chance to fix it. Part B (consumers) and Part C (businesses) say what you are entitled to if we cannot.
13. Your personal information
- Our privacy notice explains what we hold about Learners and buyers, why, who else handles it (including Stripe for payments and the AI marking service), how long we keep it, and your rights. It forms part of these terms.
- The Learner's name appears on the public verify page for anyone who has the Certificate's code. A Learner can ask us to erase their personal data at any time; the Certificate then shows as Withdrawn.
- Marketing. If you buy a Course for yourself, you can tick "Don't send me tips and offers" at checkout. If you do not tick it, we may email you about changes to the Regulations and guidance, new Courses and offers. (Privacy and Electronic Communications (EC Directive) Regulations 2003, regulation 22(3).) If a business buys your place, its tick does not count for you: we email you news and offers only if you tick the opt-in box when you set your password, and you can withdraw that consent at any time. Every such email has an unsubscribe link. Emails about your Order, sign-in, exam result, Certificate and its expiry are part of the service, not marketing, and are sent regardless; service emails never contain offers or promotions.
14. Suspending or ending your access
- We may suspend an account that breaks section 7 or puts other Learners or our systems at risk. We will tell you why, and restore access once the problem is dealt with, unless the breach is serious or repeated.
- We may end your access and this agreement for a serious or repeated breach of section 7, with notice where we can give it. No refund is due for access ended under this section, except any amount the law requires us to return for the part of the Access period you have lost.
- You may close your account at any time from your account page ("Delete my account"). Closing it ends your access to every Course and cannot be undone. It does not give you a refund except as Part B provides.
Part B - If you buy as a consumer
This Part applies if you are an individual buying for purposes wholly or mainly outside your trade, business, craft or profession. An employee buying personally for their own job is a consumer. Nothing in these terms takes away rights the law gives you as a consumer. Where a term would, the law applies instead. (Consumer Rights Act 2015, sections 47, 57 and 62.)
15. Your right to cancel
- You have the right to cancel your Order within 14 days without giving any reason. The 14 days run from the day after the day the contract is made (section 3), that is, the day after your payment is confirmed. (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulations 29 and 30.)
- To cancel, tell us clearly before the 14 days end. The easiest way is an email to support@clarity-oo.com giving your order reference; you can also write to us at 2b Henry Street, Blackburn, BB1 4JJ, or use the model cancellation form at the end of these terms. You do not have to use the form, and any clear statement will do. If you email from a different address to the one on your Order, we may ask you to confirm it is you before refunding. It is enough that you send your cancellation before the 14 days end. (Regulation 32.)
- If you cancel, we refund everything you paid, without undue delay and within 14 days of the day you tell us, to the card you paid with. (Regulation 34.) Your access to the Course ends when we receive your cancellation.
16. Starting the course, and losing the right to cancel
- A Course is digital content supplied online. The law lets you lose the right to cancel such content once you ask us to supply it within the 14 days, provided you consent to that and acknowledge the loss. (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 37.)
- We do not supply the Course until you ask. During the 14 days, buying a Course, setting your password, signing in and looking at your dashboard and the Course's module list do not start it, and your right to cancel is untouched.
- The Course starts when you open its first lesson or start its exam. Inside the 14 days, before we show you any lesson, we show you one screen with these exact words, one button and nothing pre-ticked:
I ask Clarity-OO Ltd to begin supplying this course, and its marking and certificate service, to me now, before my 14-day cancellation period has ended. I understand that once supply begins I lose my right to cancel this order and to a refund.
The button reads "Start the course now". If you press it, we record the date and time and the exact words you were shown, supply the Course, and your right to cancel ends at that moment. We email you a copy of this request and acknowledgement straight away, as the law requires (regulation 16(3)). If you do not press it, you can leave and your right to cancel continues until the 14 days end. - After the 14 days have ended, the Course opens without that screen, because the cancellation period is over. - No partial refunds. Because the Course is digital content, there is no pro-rata refund for a Course you have started and then stop. Your Access period and free retakes remain yours to use. - If the law treats any part of a Course as a service rather than digital content, and you cancel after "Start the course now" but within the 14 days, we may keep a proportionate amount for what has been supplied and refund the rest. (Regulation 36.) - This section does not affect your rights under section 18 if the Course is faulty.
17. How we refund
- Refunds go back to the card you paid with, within 14 days of the day we agree the refund or receive your valid cancellation. Your bank's own processing may add a few days.
- We refund in full if we charge you wrongly (for example twice), if we refuse your Order after payment (section 3), or if we withdraw a Course you have not started (section 11).
- Our refunds and cancellation page repeats this in plain words and forms part of these terms.
18. If the course is faulty: your rights under the Consumer Rights Act 2015
- The Course must be of satisfactory quality, fit for its purpose and as described on its course page and in these terms. (Consumer Rights Act 2015, sections 34 to 36, digital content.) Our marking of your Assessment and the issue of your Certificate must be carried out with reasonable care and skill. (Section 49, services.) Information we give you about a Course before you buy, including on the course page, forms part of the contract. (Sections 37 and 50.)
- If the Course does not meet these standards, you are entitled to have it repaired or replaced (for example a corrected module, or a reset exam attempt) within a reasonable time and without significant inconvenience; if that is impossible or we fail to do it, to a price reduction, up to the full price. (Sections 42 to 44.) If our marking or Certificate service is not carried out with reasonable care and skill, you are entitled to have it done again or to a price reduction. (Sections 54 to 56.)
- If our digital content damages your device or other digital content of yours and we did not use reasonable care and skill, we will repair the damage or compensate you. (Section 46.)
- These rights are in addition to your right to cancel in section 15, and we cannot exclude them. (Sections 47 and 57.)
- Tell us at support@clarity-oo.com, describing the problem. We will acknowledge within 2 working days and tell you what we will do.
19. Our responsibility to you as a consumer
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen, or if both of us knew it might when the contract was made.
- We are not responsible for business losses. If you are a consumer, we supply the Course for your own learning. We are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity, including where a Course or Certificate is used in connection with your work.
- We do not limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your rights under sections 34 to 37, 41, 46 and 49 to 52 of the Consumer Rights Act 2015, or for anything else the law does not allow us to limit.
- The Certificate is not advice. Decisions about who to appoint, how to run a site, and how to meet the Construction (Design and Management) Regulations 2015 remain the responsibility of the dutyholders concerned. Section 9 says what the Certificate does and does not mean.
Part C - If you buy as a business
This Part applies if you buy as a company, partnership, sole trader, charity, public body or other organisation, or as an individual for purposes of your trade, business, craft or profession. You tell us this at checkout by ticking "I am buying as a business (a company, partnership, sole trader or other organisation, or for my own trade or profession). Employees buying for their own job should not tick this." and giving a business name (and, if you wish, a VAT number). An employee buying personally for their own job is a consumer, and Part B applies to them even if they tick the box. If you buy for a business, "you" in these terms means that business.
20. Who you are, and your authority
- You confirm that the person completing the Order has authority to bind the business to these terms and to pay the price, and that the Learner named at checkout has agreed to take the Course and to our handling of their personal data as our privacy notice describes.
- The Course is bought for the one Learner named. The Learner's account, exam and Certificate are personal to them (section 7). The business does not get access to the Learner's account, answers or progress; the Learner may share their Certificate and pack with you as they see fit. Correcting the Learner's name is done as section 7 says.
- You are responsible for making sure the Learner complies with section 7.
21. No cancellation or refund
- A business purchase cannot be cancelled and is not refundable once Stripe has confirmed payment, whether or not the Learner has started the Course. The consumer right to cancel in Part B does not apply to business purchases.
- The only exceptions are: we charged you wrongly (for example twice); we refused your Order after payment (section 3); we withdrew a Course before the Learner started it (section 11); or the remedies in section 22. In those cases we refund to the card you paid with within 14 days of agreeing to.
22. If we fall short
- We supply the Course and mark the Assessment with reasonable care and skill, and as described on the course page. (Supply of Goods and Services Act 1982, section 13.) If we fail to, and do not put it right within a reasonable time of you telling us, we will, at our option, correct it (for example a corrected module or a reset exam attempt), or refund the price of the Course concerned, in full or in part according to how much of it was affected. That is your sole remedy for a Course that does not meet these terms, subject to section 23.
23. Limits on our liability to a business
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit. (Unfair Contract Terms Act 1977, section 2(1).)
- Subject to that, neither of us is liable to the other for loss of profit, revenue, business, contracts, anticipated savings or goodwill, or for any indirect or consequential loss, however arising.
- Subject to that, our total liability to you for all loss of any kind arising from or connected with an Order, whether in contract, negligence, breach of statutory duty or otherwise, is limited to the price you paid for that Order.
- Reliance on the Certificate. You acknowledge section 9: a Certificate records a pass in our assessment and is not a statement about the Learner's competence, experience or your organisation's capability under the Construction (Design and Management) Regulations 2015. Any decision to appoint, employ or rely on the Learner is yours, and we accept no liability for it.
- We give no indemnities, and no warranties, conditions or other terms beyond those these terms state. Any term implied by law that these terms are permitted to exclude is excluded.
Part D - Everyone
24. Complaints
- If something has gone wrong, please tell us first at support@clarity-oo.com with your order reference. We will acknowledge within 2 working days, look into it properly, and give you our answer within 14 days, or tell you why we need longer.
- If you are a consumer and we cannot resolve your complaint, our final response will say so and will name a certified alternative dispute resolution (ADR) body and say whether we will use it. We are not obliged to use ADR and do not currently commit to it. (Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, regulation 19.) You can also go to court (section 27).
25. Changes to these terms
- The version of these terms that applies to an Order is the one in force when the Order was placed. It is named in your confirmation email and on your invoice page.
- We may change these terms for future Orders at any time by publishing the new version. We may also change them for an existing Order where the law or a supplier we depend on requires it, or to make them clearer; if such a change would be to your disadvantage we will email you at least 30 days before it takes effect, and if you are a consumer you may end the agreement before the change takes effect and we will refund the price less a fair amount for what you have already received (nothing is deducted if you have not started the Course).
26. General
- Whole agreement. These terms, the privacy notice, the refunds and cancellation page, the cookies page and your confirmation email are the whole agreement between us about your Order.
- Transfer. We may transfer our rights and obligations to another company that takes over the Academy, and will tell you if we do; your rights are not reduced by it. Your Order and the Learner's account are personal and may not be transferred.
- Events beyond control. Neither of us is responsible for delay or failure caused by events beyond our reasonable control. If such an event stops a consumer who has not started the Course from using it for more than 30 days, they may cancel and be refunded.
- Notices. Notices are given by email: to support@clarity-oo.com, and to the email address on your Order.
- If part of these terms is unenforceable, the rest still applies.
- Third parties. Nobody other than you, the Learner and us has rights under these terms. Where a business buys, the Learner agrees to Parts A and D when they set their password, and Part C's rights and duties belong to the business.
- No waiver. If we do not insist on a term straight away, we can still insist on it later.
27. Law and courts
- These terms, and any dispute about them, are governed by the law of England and Wales.
- If you are a consumer living in Scotland or Northern Ireland, you also have the benefit of any mandatory consumer protection rules of the law where you live, and you may bring proceedings in the courts of that part of the United Kingdom as well as in England and Wales. We will bring proceedings against a consumer only in the courts of the part of the United Kingdom where they live.
- If you buy as a business, the courts of England and Wales have exclusive jurisdiction.
